Terms of Service

These Terms of Service ("Terms") govern your access to and use of Everything Musician (the "Service"), including the website, the member profiles, the messaging features, and the gear listings. Please read them carefully. By creating an account or using the Service you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 16 years old to create an account. By registering you represent that you meet that requirement, that the information you provide is accurate, and that you are not barred from using the Service under any applicable law. If you are creating a profile on behalf of a band or other group, you represent that you are authorised to act for it and to accept these Terms on its behalf.

2. Your account

You are responsible for your account, for keeping your password confidential, and for everything that happens under your login. Tell us promptly if you believe your account has been used without your permission. You may not sell, rent, or transfer your account to anyone else, and you may not create an account for someone else without their permission or impersonate any person or group.

3. Your content

"Your Content" means anything you post, upload, or send through the Service: profile text, photographs, audio and video recordings, gear listings, and messages. You keep ownership of Your Content. You are solely responsible for it, and for having the rights necessary to share it.

By posting Your Content you grant Everything Musician a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, adapt for technical purposes such as resizing or transcoding, and display Your Content for the purpose of operating and promoting the Service. This licence exists so we can show your profile to other members and ends when you delete the content or your account, except for copies kept in routine backups for a reasonable period and any copies other members have already saved or shared.

We do not claim ownership of your recordings, compositions, or performances, and we do not licence them to third parties for their own commercial use.

4. Acceptable use

You agree not to use the Service to:

• post content you do not have the right to post, including recordings, images, or compositions belonging to someone else;
• harass, threaten, defame, stalk, or intimidate any person, or encourage others to do so;
• post content that is unlawful, hateful, sexually explicit, or that exploits or endangers minors;
• send unsolicited commercial messages, chain messages, or bulk solicitations to other members;
• misrepresent your identity, your abilities, your affiliation with any person or group, or the condition or ownership of gear you list;
• scrape, crawl, harvest, or otherwise collect member information by automated means, or use the Service to build a competing database;
• upload malware, attempt to gain unauthorised access to any account or system, probe or test the security of the Service, or interfere with its normal operation;
• use the Service for any unlawful purpose or in breach of any applicable law.

5. Meeting other members

The Service helps musicians and bands find each other, but we do not screen, verify, or perform background checks on members. We make no representation about the identity, skill, character, or intentions of anyone you meet through the Service. You are solely responsible for your dealings with other members, online and in person. Take the precautions you would take meeting any stranger: meet somewhere public where you can, tell someone where you are going, and use your judgement.

6. Gear listings

Members may advertise equipment through the Service. We are not a broker, dealer, auctioneer, agent, or escrow service, and we take no part in any transaction. We do not inspect items, verify ownership, or confirm condition, authenticity, or legality. Any purchase, payment, exchange, or delivery is arranged strictly between the members involved and is at their own risk.

7. Copyright and takedown

We respect intellectual property rights and expect our members to do the same. If you believe content on the Service infringes your copyright, send us a notice identifying the work, the material you say is infringing and where it appears, your contact details, a statement that you believe in good faith that the use is not authorised, and a statement that the information in your notice is accurate. We may remove content and may suspend or terminate accounts that repeatedly infringe.

8. Moderation and termination

We may remove content or suspend or terminate an account that we reasonably believe breaches these Terms or creates risk for other members or for us. Where it is practical and lawful to do so we will tell you why. You may close your account at any time. Sections that by their nature should survive termination — including sections 3, 9, 10, 11 and 13 — will do so.

9. Privacy

Information you put on your profile is visible to other members according to the visibility setting you choose. Your street address is never shown publicly; location is displayed at city, state, and zip level so that distance searches can work. We do not sell member information. Handle other members' information with the same care you would want for your own.

We also keep a record of which pages are opened on the Service, so that we can see which parts of it are being used and which are not. Each record holds the name of the page, the date and time, and — if you were signed in — your member id. If you were not signed in, it holds a scrambled, one-way code standing for your browsing session, which cannot be turned back into anything that identifies you. We do not record your IP address, and we do not record what you typed into a search box or any other information you entered on the page.

These records are used only by us, to understand how the Service is used and to decide what to work on next. They are not shared with anyone else and they are not used to build advertising profiles. We keep them for no longer than twenty-four months. If you close your account, the records of your visits are anonymised: the visit remains in the totals, and the connection to you does not.

Separately from those records, the public pages of the Service — the home page, the Gig Calendar, the searches, and the sign-up form — carry an advertising measurement script from Meta, the company that runs Facebook and Instagram. It tells Meta that a browser opened one of those pages, so that we can advertise the Service on Facebook and see whether those adverts brought anyone here. If you are signed in to Facebook or Instagram in the same browser, Meta can connect that visit to your account there; that connection is made by Meta, not by us, and we never see it.

Three things about it are worth saying plainly. It does not run on any page you reach after signing in, so nothing you do as a member is reported to Meta. We do not send Meta your name, your email address, your phone number or anything else you typed — the optional feature that would do so is switched off. And what we get back is a count, never a list: we can see how many people an advert brought, and never which ones. If you would rather not be included at all, a tracker-blocking extension or your browser's own protection will stop the script loading, and the Service works exactly the same without it.

10. No warranty

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any content on it is accurate or reliable.

11. Limitation of liability

To the fullest extent permitted by law, Everything Musician and the people who run it will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, goodwill, or opportunity, arising out of or connected with your use of the Service — including anything arising from your dealings with other members. Nothing in these Terms excludes liability that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify and hold harmless Everything Musician from claims, damages, and reasonable legal costs arising out of Your Content, your use of the Service, or your breach of these Terms.

13. Disputes and governing law

These Terms are governed by the laws of the state in which the Service is operated, without regard to its conflict-of-laws rules. If a dispute arises, we ask that you contact us first so we can try to resolve it informally.

14. Changes to these Terms

We may revise these Terms from time to time. When we make a material change we will update the version shown at the top of this page and, where appropriate, ask members to accept the revised Terms. Continuing to use the Service after a change takes effect means you accept the revised Terms.
